The Religious leaders opposed the draft law which they said to be against the Shari’a and the constitution
Hargeisa ( ANN)-The House of Representatives returned the Draft Law for Commercial Banks in Somaliland, requesting the Drafted to be adjusted to the Shari’a and the Constitution, which it contradicts in its present form.
An ad Hoc Committee was formed by the House of Representatives, after the draft was debated heatedly and most prominent religious leaders and Imams of mosques in Hargeisa gave sermons that the draft is against Islamic Shari’a and the constitution.
The committee distributed the draft to the prominent religious leaders in the country; who in their report suggested that the law wasn’t viable to the Shari’a and constitution.
The Ad Hoc Committee in its report to the House recommended:
1- That it is a religious and constitutional obligation to avoid any transaction based on interest
2- The House of Representatives to respect and abide by the proposition of Somaliland prominent religious leaders, which is based on the the Shari’a Law and Constitution, and stop the Draft Law on Commercial Banks and return it to the government.
3- Voting for an issue (Such as Interest) which is against Islam to be illegal in accordance to the Shari’a and the Constitution.
Meanwhile in a press conference, prominent religious leaders described voting for Commercial Bank draft law- in its form and legalizing interest to be a grest sin, which can have dire consequences o the people, country, businessmen and members of the House of Representatives that pass the law.
Sheikh Mohamed Sheikh Omer Dirir speaking in the name of religious leaders said, “We rarely hold press conference, but we have been forced to do that due to its proximity of the welfare of the people, businessmen, owners of Islamic Banks of the negative effects of interest to our lives in this world and the next one as well.
“The Kuran and Hadith have explicitly taught us of the negativity of taking interest. Prophet Mohamed’s (PBUH) has taught us that committing 60 adulteries to be a lesser crime than taking an interest of one shilling. The sin of interest will affect everyone and as such I would remind members of the House of Representatives before God for their action if they pass this law.” Said Sheikh Mohamed Sheikh Omer Dirir.
He urged Islamic Banks to give loans to the poor also and not limit themselves to the haves only and attach conditions on loans such as having economy, or other guarantees.
